A Perth-based company tax agent has been terminated after multiple code breaches, including failing to have any registered tax agents supervising the firm’s staff.

The Tax Practitioners Board has terminated Hillview Taxation and Business Solutions Pty Ltd’s company tax agent registration due to multiple breaches of the Code of Professional Conduct.

A TPB investigation in late 2020 found that Hillview Taxation had failed to lodge outstanding tax returns and business activity statements, and had failed to pay an undisclosed amount of outstanding tax debts.
Hillview Taxation was also found to have failed to maintain professional indemnity insurance and did not respond to multiple letters from the TPB requesting them to provide information.
The TPB also found that the company did not have any individually registered tax agents to carry out supervisory arrangements at the firm since 1 November 2019.
TPB chair Ian Klug said the registration termination was necessary to protect taxpayers from engaging practitioners who failed to operate lawfully and in accordance with standards of professional and ethical conduct.
“Nearly three-quarters of all taxpayers rely on tax practitioners to get their taxes right,” Mr Klug said. “The vast majority of tax advisers provide excellent service to clients and operate competently and within the requirements set out in the Tax Agent Services Act 2009.

“This action against Hillview shows our commitment to protecting consumers, honest practitioners and to maintaining the integrity of the tax system.
“As we approach tax time, we recommend consumers search the TPB public register to ensure that their tax agent is both registered and not subject to TPB sanctions.”
